ENVIRONMENTAL CLEARANCE FOR MINING OF MINOR MINERAL IN INDIA ( Category B2 PROJECTS) with special focus on Sustainable Sand Mining

ENVIRONMENTAL CLEARANCE FOR MINING OF MINOR MINERAL IN INDIA 
( Category B2 PROJECTS ) with special focus on Sustainable Sand Mining

The following amendments in EIA Notification 2006 was notified by MOEF, GOI on 15.1.2016 vide SO No. 141 (E).



Purpose
Authority to appraise or grant EC
1. Grant of Environmental Clearance (EC)
for Mining Lease Area up to 5 hectares  of Individual Mining Lease of Minor Minerals.

Category : B2 Projects

District Environmental Impact Assessment  Authority (DEIAA) headed by District Collector/DM.

District Expert Appraisal Committee (DEAC) will assist DEIAA.  Executive Engineer, Irrigation department of the said District will be the Chairman of DEAC.
2. Grant of Environmental Clearance (EC)
for Mining Lease Area up to 25 hectares in clusters (with no individual Lease greater than 5 hectares) of Mining Lease of Minor Minerals.

Category :- B2 Projects

District Environmental Impact Assessment  Authority (DEIAA) headed by District Collector/DM.

District Expert Appraisal Committee (DEAC) will assist DEIAA.  Executive Engineer, Irrigation department of the said District will be the Chairman of DEAC.


DEIAA & DEAC

Constituted under sub section (3) of section 3 of the EP Act, 1986 by Central Government. Chairman of DEIAA shall be EC granting authority. DEAC shall assist DEIAA in functions of appraisal and EC grant.

Organization Structure of DEIAA
1. Comprises of 4 Persons
2. DM/ District Collector shall be the Chairman
3. SDO shall be the Member secretary
4. Sub Divisional Forest Officer shall be the Member
5. Expert shall be the Member

Organization Structure of DEAC
1. Comprises of 11 Persons
2. Executive Engineer, Irrigation Department shall be the Chairman
3. S-DFO (Forest)
4. SPCB concerned official
5. Concerned authority from district mines or geology department
6. Concerned authority from state geology or state groundwater or state remote sensing department
7. Medical officer nominated by DM/DC
8. Engineer from ZP or concerned authority
9. PWD Engineer or concerned authority
10. Three expert member nominated by Divisional commissioner of CCF (Forest)




 The following requirements remained as it is

3. Grant of EC for Mining Lease area greater than 25 Ha & less than 50 Ha for Mining of Minor Minerals  (Category B1 Projects) will taken care by SEIAA.

4. Grant of EC for Mining Lease area greater than  50 Ha for Mining of Minor Minerals -
(Category A Projects) will taken care by Central - EAC / MoEFCC.
